Hearing canceled in case of Cuban teenager accused of killing his mother in Hialeah

The minor, 13 years old, is being tried as an adult.

This Monday, a court hearing scheduled for July 15th was canceled for the case of Derek Rosa, the 13-year-old teenager accused of stabbing his mother to death in Hialeah, as reported by Telemundo 51.

At the moment, the reason why the hearing scheduled for today was suspended has not been disclosed.

During a previous hearing in April, Rosa was not present but her family members did attend the court along with about 50 people who support the minor and claim he is innocent.

After the April hearing, Dayliset Rielo, one of the lawyers representing Rosa, expressed her concern about the regime in which the teenager is being held in prison.

Last year, the judge in charge of the case, Richard Hersch, denied a defense motion to transfer Derek Rosa from Metrowest, an adult jail, to a juvenile detention center.

On the night of October 12, 2023, Rosa allegedly stabbed her mother to death while the woman was sleeping.

He did it in front of his little sister, who was just 14 days old, and then called 911, where he gave details of what happened inside the apartment located at 211 West and 79 Place in Hialeah.

At various moments during the call, the operator was heard asking the child why he killed his mother. He did not respond to this.

After the crime, Derek Rosa took photos of his mother's body and sent them to a friend, as revealed by the police. He later told the same friend that he had killed her.

When the authorities arrived, the child came out with his hands up. The body of his mother, Irina García, 39 years old, lay stabbed next to the baby's crib.

At the beginning of February this year, new images were released - from the doorbell security camera - showing the 13-year-old teenager talking to his mother inside their apartment hours before calling the police to report that he had killed her.

The case has sparked great interest within and outside of the United States, where there is a movement of mothers calling for the investigation of other alleged individuals involved in the case, and they believe the teenager is innocent.

Derek Rosa will be tried as an adult for first-degree murder.
