The Barcelona Court granted provisional release to former Barcelona player Dani Alves on bail of one million euros, while awaiting confirmation of a sentence that sentenced him to four and a half years in prison for raping a young woman in a nightclub.

In an order issued, the Barcelona Court granted the benefit to Alves after paying the bail and imposing strict conditions, which include the surrender of his two passports (Spanish and Brazilian), the prohibition of leaving Spain and the obligation to appear. weekly before the court, the agency noted WHICH.

In addition, it prohibits him from approaching less than 1,000 meters from the victim's home, his place of work and other places he may frequent, as well as from communicating with him in any way.

Alves' defense is currently in the process of raising the sum required by the court for his release.

The main impediment for the footballer to pay this amount is that most of the former footballer's bank accounts are seized or have a negative balance due to various debts.

The specialized medium Sports world reported that Alves may possibly ask Neymar's father to lend him the money to get out of jail this Wednesday.

Neymar Jr.'s father had already lent Alves 150,000 euros to repair the damage to the victim, which served as a mitigating factor in the sentence handed down against him last February.

The former footballer will not be able to leave prison until he deposits the million euros in the court account and a new order is issued authorizing his release from prison.

The Prosecutor's Office opposed the conditional release measure, arguing that the risk of flight persists due to the former player's high economic capacity.

The victim's lawyer, Ester García, has also assured that she will appeal the decision of the section 21 court of the Barcelona Court to release him provisionally if he pays one million euros in bail, and stated that "Justice is being done for rich."

In an interview on Rac 1 this Wednesday, the lawyer stated that she is "very surprised and very indignant" with this resolution.

The Court responded that although there is a certain risk of flight, this can be counteracted with measures such as the imposed bail and the prohibition of leaving the country. Furthermore, he highlighted that the sentence imposed on Alves has been reduced and that he has already been in preventive detention for 14 months.

One of the judges in the courtroom cast a dissenting vote in disagreement with the majority, arguing that Alves should remain in prison because the risk of escape has been reinforced by the sentence and the possibility that it will increase with the pending appeals.

Alves's defense, meanwhile, has stressed his commitment to remain available to the court at all times, recalling that he voluntarily surrendered to the authorities when he learned that he was being investigated for the rape case.

The events occurred on the night of December 30, 2022 at the Sutton nightclub in Barcelona, and were immediately reported by the victim, a 23-year-old girl. The former Barça footballer was immediately arrested and placed in provisional prison without bail.

After a judicial process that lasted two weeks, the court determined that Alves violently sexually assaulted the complainant in the bathroom of the aforementioned nightclub.

Despite the testimonies presented by the former soccer player and other witnesses, including the victim and people present at the scene, the court concluded that there was an absence of consent on the part of the young woman, who expressed her refusal clearly during the incident.
