Cuban teenager accused of murdering his mother returns to court in Miami

Derek Rosa, the Cuban-American teenager who shocked the Hialeah community after confessing to having killed his mother in 2023, made headlines again this Friday by participating in a court hearing via Zoom, dressed in a brown jumpsuit for minors, wearing glasses and with short hair.

Rosa, who is now 14 years old, faces first-degree murder charges for the death of her mother, Irina García, while she was sleeping next to a two-week-old baby.

While awaiting trial, the teenager remains detained at the Metro West Detention Center, an adult facility in South Florida.

Rosa's new appearance was due to a new defense argument that could change the direction of the case: identifying Frank Ramos, the victim's husband and Rosa's stepfather, as a possible alternative suspect, reported NBC Miami.

According to court documents, the attorneys requested access to Facebook messages held by the prosecution, which would include conversations where Ramos allegedly revealed specific details of the crime, such as Irina García's reaction when attacked. It is said that she got out of bed, called for help, and confronted the assailant, who ultimately delivered 46 stab wounds, as detailed by the police in an earlier phase.

However, the prosecutors in the case objected to the introduction of these conversations as evidence. They argue that the GPS evidence confirms that Frank Ramos was traveling on the I-95 headed to Georgia at the time of the murder.

“The content of the conversations shows that Ramos declares himself innocent, calls for justice for the death of his loved one, and expresses empathy for the tragedy,” explained assistant prosecutor Jonathan Borst.

Moreover, Ramos has stated that he obtained those details from the conversations with the agents who interrogated him after García's death.

Judge Richard Hersch indicated that he will privately review the messages to determine if they are relevant and should be turned over to the defense.

Derek Rosa's trial is scheduled for June, but the defense has requested a postponement, arguing that there is still key evidence to review, witnesses to interview, and time needed for a medical expert to evaluate the young man. Additionally, they do not rule out basing part of their defense on mental health issues.

"Unlike other cases, we are not going to wait six months to see what happens, especially when we have a 14-year-old in custody awaiting trial," warned Judge Hersch during the hearing.

Derek Rosa has pleaded not guilty to the charges against him; however, his story has generated widespread interest not only due to the severity of the crime but also because of the personal circumstances of the teenager and the strategy of his defense, which now seeks to cast doubt on his direct responsibility in the homicide.
