They are calling for prison for a Cuban in Gran Canaria: This is what the Prosecutor's Office is investigating

The Spanish Prosecutor's Office has requested the prosecution of a Cuban citizen identified as AMR for the alleged sexual assault of a 16-year-old minor in the early hours of May 6, 2023, in a home in southern Gran Canaria, reported the local media Maspalomas.

The case is being processed by the Investigating Court No. 3 of San Bartolomé de Tirajana, and the Public Prosecutor's Office requests that the proceedings be transferred to the competent section of the Provincial Court for trial, which indicates that the instruction phase is practically concluded.

According to the indictment, the accused placed a mattress next to the bed where his daughter was sleeping with her friend, identified as SDR, born in 2008, and engaged in sexual acts. Later, the minor went to the bathroom and rejected the accused's request for a kiss.

The complaint was filed that same day by the mother and legal representative of the minor with the National Police of Maspalomas.

The psychological expert report included in the file concludes that the victim exhibits emotional, cognitive, and social sequelae consistent with post-traumatic stress disorder featuring dissociative symptoms related to the investigated events.

The Prosecutor's Office classifies the events as a crime of sexual assault against a minor under 16 years of age, as defined in Article 181.1 of the Penal Code, and accuses AMR as the perpetrator of the crime under Articles 27 and 28 of the same legal text. The document states that there are no mitigating or aggravating circumstances.

As the main penalty, the Prosecutor's Office requests four years of imprisonment, a figure that falls in the middle of the range of two to six years established by Article 181.1 of the Penal Code for this type of offense.

In addition to the prison sentence, four years of supervised probation are requested after the completion of the sentence, with a requirement to notify any changes in residence or employment.

The accusation also seeks the revocation of parental rights for six years and disqualification from exercising any profession or trade for eight years. Additionally, a restraining order is requested to prohibit the accused from approaching or communicating with the victim for four years.

In the civil context, the Public Prosecutor's Office is seeking compensation of 18,000 euros for the victim, along with the applicable legal interest.

This is not the first case of a Cuban citizen being prosecuted for sexual offenses against minors in Gran Canaria. In 2018, the Prosecutor's Office of the Provincial Court of Las Palmas requested 17 years and ten months in prison for another Cuban accused of abusing five minors online between 2013 and 2014.
