This video ofAristaeus Group, which provides immigration and immigration services in Madrid, Spain, explains what steps they should followCuban parents in the Iberian country who want to register their children as Spanish.
Estela Marina, general director of the Group, clarifies that newborns in Spain of Cuban parents can obtain Spanish nationality by “simple presumption” if they follow two basic steps.
Before indicating the steps, the lawyer emphasizes that the first thing that must be taken into account is that the child cannot be registered at the Cuban consulate.
Nor can there be a record of application for Cuban citizenship by birth for the child in this consulate, because in this way he would have to respond to Cuban laws and the right to Spanish nationality would not apply due to “simple presumption.”
Having this clear, the rest is very simple, the lawyer assures the Cuban community in Spain.
The first step would be to take the birth certificate from the hospital to the corresponding Cuban consulate.
Then, ask the Cuban consulate for a certificate that guarantees that the child is not registered there nor has he/she requested Cuban citizenship by birth.
The lawyer even shows in her video two certificates issued recently, in January and April of this year, by the Cuban consulate.
With these certificates you must go to the civil registry to register the minor as a Spanish citizen.even if the parents do not reside in Spainclarifies the lawyer.
In addition, he specified that lawyers from his Legal Assistance Group have consulted the Cuban consulate in Madrid and officials have confirmed the current issuance of these certificates.
