Government of Cuba prepares to make confiscations for "undue enrichment"

The Attorney General's Office warns that the confiscatory administrative procedure in force in Cuba has a high level of obsolescence.


The Cuban regime is preparing toconfiscations for "unjust enrichment" and announced that they are updating the regulations to undertake this task in the new context in the country.

TheAttorney General's Office of the Republic of Cuba published on its website adocument in which it warns that "the confiscatory administrative procedure in force in Cuba since 1994, presents a high level of obsolescence, compared to the transformations carried out in the legal order, with the promulgation of the Constitution of the Republic of Cuba of 2019."

The state agency warned that "It is urgent to perfect its application"and assure that these confiscatory procedures will be a "guarantee for effective administrative justice."

In the text they recalled that in1994 the National Assembly of People's Power agreed "entrust the Council of State, the adoption with the required speed ofeffective and exemplary measures against those who obtain illegitimate assets, accumulating wealth and material goods, outside of what is legally established."

The institution assured that the decision of the Assembly at that time was a response "to the demand of the majority of the people" and considers that in 2023 these procedures must be brought into line with the reality that the country is experiencing.

TheProsecutor's Office insists that it has, as an institution of the Cuban State, the "legal powers to investigate and substantiate the procedure."

They specify that "the prosecutor must demonstrate the means or source of enrichment and the disproportion between the lawful income received by the accused and the real value of his assets."

On the other hand it would bethe affected, to whom "It is necessary to demonstrate the legality of the income used in the increase of his assets, without prejudice to the obligation of the Prosecutor's Office to verify the legality of the same or to prove the income in the event that the filer does not do so.

This procedure in 1994 was popularly known as the confrontation of theState against "the potters", who were entrepreneurs to whom the regime gave rope, but when they became rich it criminalized them and confiscated their properties. Some ended up in prison and others in exile.

The Prosecutor's Office already has a first investigation that supports its project. It was published on the official website with the titleThe confiscation procedure for undue enrichment, proposal for its improvement in Cuba. It is signed by the attorney.Yilian Toranzo Other who is the Provincial Prosecutor of Las Tunas.

The text of the Prosecutor's Office comes to light after the recent statements of the president of the National Assembly of People's Power,Esteban Lazo, who asked for a tough hand from the State.

"The sanction that hurts people the most here is having their things taken away.. That's more than the fines. I take away your merchandise, I take away your property for violating the law, because you have to respect the laws of this country. "This is a country of law, if you have a license I will take it away from you and if you continue violating the laws, you go to court," Lazo said in Parliament's Economic Affairs Committee.
