Cubalex warns about violation of citizen rights in the new Penal Code

The organization warns that the new Code ratifies that the State, the government and the party are above the rights of citizens.

The independent organization Cubalex warned this Friday about the new Cuban Penal Code and clarified some points that violate the rights of national citizens.

In ainfographic posted In its networks, Cubalex warned that the new code ratifies that the State, the Government and the Party are above the rights of citizens.

In addition, it includes the punishment of people, organizations that receive foreign financing, it does not have policies to reduce the number of prisoners in theprisons of the island, does not classify the crime of Femicide, and criminalizes the use of social networks.

The NGO advises Cubans to "say no to the Penal Code" that was implemented by theregime since last December 1, because it makes the population more vulnerable to the totalitarian State.

Cubalex on Penal Code

Law 151/2022, the Cuban Penal Code, came into force last December with a wide arsenal of legal mechanisms to justify repression against citizens.

Cubalex, based in the United States, remembers that the Code is a concern for all citizens, for different reasons:

- Classifies criminal, ambiguous, broad and discretionary conduct

- There are around 32 crimes that threaten freedom of expression

- The use of cyberspace as an aggravating factor in criminal liability

- The crime of doing independent journalism

Cubalex on the New Cuban Penal Code

- The death penalty is maintained

- The use of therapeutic safety measures

- Criminal responsibility is from the age of 16

- Non-recognition of feminicide

- They criminalize the dissemination of satellite, television, radio or similar signals

- Allow electronic surveillance

- Monopoly of criminal action in electoral conduct

The document was approved in May, during a session of the National Assembly of People's Power, and included 37 new crimes, such as public disorder.
