Secret Service releases phone of Derek Rosa, teenager accused of murdering his mother in Hialeah

The 13-year-old is accused of stabbing his mother 46 times.

The United States Secret Service released the cell phone of Cuban teenager Derek Rosa, from which he would have obtained important information related to the confessed murder of the minor's mother last October.

The case of the young man, accused of murdering his mother in Hialeah last October, returned to court this Wednesday for a hearing where the prosecution had to respond to the defense's claims.

A police officer testified that Rosa allegedly stabbed 39-year-old Irina García 46 times while she slept next to a 14-day-old baby on October 12, 2023, at the Amelia Oaks apartment complex, located in 211 W. 79th Place in Hialeah.

This Wednesday the defense claimed the delay in the delivery of evidence, including all the images from the Police Department's body cameras, reportedLocal 10.

Additionally, he requested the results of the physical evidence collected at the scene, including the murder weapon, a fragment of the knife that had broken, and the clothing that Rosa was wearing at the time of the crime.

The prosecutor responded before experienced Judge Richard Hersch of Miami-Dade County that "the knife, the knife fragment and the clothing had just been sent to the laboratory, so they did not have the results yet."

"You have had this material for six months," the judge asked, to which the prosecutor said that "You did not have this material at all," because it was barely handed over by the Secret Service.

"When was it sent to the lab?" Hersch asked.

"I think it was sent to the lab just this week," the prosecutor responded.

He then explained that Rosa's phonehad just been returned by the Secret Service, although three tablets and an XBox remained in the Property Room of the Police Department.

The judge then asked why those other electronic devices were not also turned over to the Secret Service.

The prosecution clarified that one of the tablets belongs to the Miami-Dade County Public Schools and that they believe that the XBox did not belong to the teenager either, even though they were collected from the home.

However, Rosa's cell phone is a key piece in this case, because through this device the young man communicated with "a friend" that he met "through social networks and video games", and to whom he sent images of the crime, as revealed by the teenager himself.

Apparently the defense already has in its possession the video of thebaby crib surveillance camera, which would have recorded the crime in its entirety. In February, Rosa's lawyer claimed that she did not have this evidence to request a delay in the start of the trial, which will finally begin in April.

Although Derek PinkHe has declared on several occasions that he murdered his mother., the motive for this crime that has shocked the country remains unclarified.

In the first interrogation after being arrested, Rosa asked for a lawyer when they asked him the reasons that led him to murder García.

The young man must return tothe court next April 19, when the trial is expected to officially begin, where he will be tried as an adult.
