An agent of the Immigration and Customs Enforcement (ICE) has been declared in contempt by a judge in Boston after detaining a migrant during a trial, sparking a wave of outrage and questions regarding the tactics of immigration authorities in the United States.
The unusual incident occurred when ICE agent Brian Sullivan arrested Wilson Martell-Lebrón, a citizen of the Dominican Republic, while he was attending his trial at the Boston Municipal Court.
The judge Mark Summerville, visibly upset, ruled that the action taken by Sullivan violated Martell-Lebrón's rights to due process and a fair trial, describing the agent's conduct as "atrocious" and "an affront to the integrity of the judicial system," reported the AP agency.
Martell-Lebrón faced charges for allegedly making false statements in his driver's license application. Following the abrupt arrest by ICE, Judge Summerville dismissed the charges against him and ordered a review of the case by the Suffolk District Attorney's Office to determine possible legal actions against Officer Sullivan.
Murat Erkan, defense attorney for Martell-Lebron, stated that prosecutors Jack Lucy and Matt Liber were apparently aware of ICE's actions but never informed either him or the judge about the planning of the arrest.
Erkan claimed that the prosecutors were "aware of an attempt to prevent [Martell-Lebron] from exercising his constitutional rights and to challenge a court order", he stated to Boston Globe.
Another of Martell-Lebrón's defense attorneys, Ryan Sullivan, strongly condemned the intervention by ICE, calling it "reprehensible" and accusing the agency of obstructing justice.
According to Sullivan, ICE agents, without identifying themselves, intercepted Martell-Lebrón as he left the courtroom, put him into a van, and sped away, preventing him from exercising his constitutional right to a jury trial.
James Borghesani, spokesperson for the Suffolk district attorney's office, stated that they were "dismayed and surprised" that the case was interrupted following the arrest of Martell-Lebron. He added that the district attorney's office requested ICE to return the defendant to court.
“Any claim that we were aware of an attempt to prevent Mr. Martell-Lebron from exercising his right to a trial is false”, states a statement.
Our intention was and continues to be to hold Mr. Martell-Lebron accountable for the alleged crimes in the complaint. Federal authorities should not have detained him or interfered with our efforts to hold him accountable.
This incident has reignited the debate over the presence of immigration agents in the courts and has generated concern among immigrant rights advocates and local officials.
