The decision was revealed by journalist Javier Díaz from Univisión through a post on Facebook, where it was also hinted that a civil action could be forthcoming from the complainant.

The controversy centers around Ronaldo Luis Mosqueda Toledo, a young man who, in October 2024, accused Santana of having engaged in sexual relations with him when he was still a minor.

This accusation led to the arrest of Santana on the charge of illegal sexual activity with a minor, a serious offense that, if confirmed, would have resulted in a sentence of up to 15 years in prison.

However, the charges were dismissed months later, when Mosqueda retracted, claiming that his original statement was the result of threats and pressure.

The case took a new turn in March of this year, when Mosqueda, now 18 years old, formally approached the Hialeah Police to request the reopening of the case.

According to statements made to Univisión, he decided to continue with his complaint after handing over his mobile phone to the authorities, on which -he claimed- there are videos of a sexual nature that would have been used to intimidate him.

"The FBI will be investigating that. The FBI will be involved here for child pornography," Mosqueda stated, also accusing Santana and Otaola of being responsible for any harm she might suffer as a result of her decision to speak out again.

Despite the complainant's insistence and the submission of alleged evidence, the Hialeah Police concluded that there are no solid grounds to reopen the criminal case.

This response has sparked criticism from the young man's circle, who have suggested a supposed lack of institutional will to fully investigate the case.

Private investigator Joe Carrillo, who has accompanied him throughout the process, expressed his frustration by saying, "There are people here who are being protected."

While the criminal case seems to have been definitively closed, Mosqueda is now reportedly preparing a civil lawsuit against Andy Santana.

The case remains open in the public eye, particularly due to the political figure linked to Santana: Alexander Otaola, a Cuban activist and influencer who announced his candidacy for the Miami-Dade mayoralty in 2024.

Otaola, for his part, has kept his distance from the events.

Upon learning of the arrest of his treasurer in October, he stated: "I have no control over the private lives of my employees... Each person will have to face the responsibility of their own actions and prove their innocence."

He also denounced that the incident was being used to attack his public image and discredit his political activism.

The controversy, far from dying down, continues to heat up with new statements, ongoing legal actions, and growing doubts about the institutional handling of the case.
