Roosevelt Sebastián Perdomo Torres, one of the two workers who survived inside the truck struck by an Amazon cargo plane at Miami International Airport, has filed a lawsuit against the company and other parties related to the flight, as he continues to recover from the injuries sustained in the accident that resulted in five fatalities.
According to a report from EFE published this weekend, the attorneys for Perdomo Torres filed the action in the Eleventh Judicial Circuit Court of Florida against Amazon, Amazon Air Cargo, companies associated with the operation of the plane, and the two pilots.
EFE identifies it as of Latin origin, although it notes that its nationality has not been disclosed.
The lawsuit seeks an unspecified amount in damages and claims that there was negligence and other failures that may have contributed to the events of September 6.
Perdomo Torres was traveling with six other cleaning workers in a Ford Econoline from Professional Ocean Service Corp. when the Boeing 767-300, operated by 21 Air for Amazon Prime Air, veered off the runway and struck the van within the airport grounds.
Five of his companions died, and he and another occupant managed to survive.
According to Local 10, the impact threw Perdomo Torres into the air and resulted in several fractures.
He remained hospitalized days after the incident, while his lawyers claim that he also suffered disfigurement and emotional damage as a result of what happened.
The complaint also states that during the approach, warnings about the aircraft's speed were issued in the cockpit.
Subsequently released data by the National Transportation Safety Board (NTSB) indicated that one of the pilots had repeatedly warned that the aircraft was approaching too quickly and even requested to abort the maneuver.
The lawsuit filed by Perdomo Torres is not the first one submitted following the tragedy.
The widow of Yoel Rodríguez Naranjo, one of the five Cuban workers who died, previously filed a lawsuit against Amazon, Amazon Air Cargo, 21 Air, and other parties seeking accountability for her husband's death.
The five individuals who died were traveling in the cleaning company's van and have been identified as Yoel Rodríguez Naranjo, Rolando Alemán León, Julio C. Pineda, Carlos Acosta Fajardo, and Javierkys Reyes Quevedo. All were of Cuban origin.
The NTSB continues to analyze the flight recorders, crew actions, weather conditions, aircraft operation, and other elements. The agency has still not officially determined the probable cause of the accident.
