Cuban father who shot and killed his son in Florida granted parole

David de Jesus Contreras, the fatherCuban accused of shooting to death his 21-year-old son in Kendall last November,will be released from jail and placed under house arrest, a judge ruled in a hearing this Tuesday.

Contreras, 52, faces a second-degree murder charge for killing his sonEric Contreras, at the family home, on November 3.

In continuation of an Arthur hearing that began in February, theJudge David H. Young granted the release of the Cuban from prison, according to a report from the channelNBC Miami.

“This was a senseless murder that took place… based on all the evidence I have heard, it was an execution-style murder,” Judge Young said. “I know the state wants me to keep him locked up, but I can't get over the fact that thisIt was an isolated incident, it does not represent a danger to the community in general, so I am going to grant him freedom.”

Young Eric Contreras, a student at Florida International University (FIU) and graduate of Christopher Columbus High School, was shot by his father in his home at 10703 SW 84th Ave., a quiet Kendall neighborhood near Pinecrest.

On November 27,Contreras pleaded “not guilty” through his attorney, during a formal arraignment in a Miami-Dade court, to which he did not appear.The defendant has been held without bail since his arrest..

On February 22, the Cuban appeared in court for the first part of the Arthur hearing, in whichHis lawyers requested that he be released on bail.. The hearing was to continue in March, but was rescheduled for April 30.

This Tuesday, the psychologist took the standDr. Michael Brannon and close friends of Contreras, who spoke in his favor and said “they do not believe that it would be harmful to himself or others if he were granted freedom.”

Brannon explained that in the psychological evaluation David scored 0 as a risk factor. The psychologist found nothing of concern and said thatthere is an “absence of factors” conducive to being or acting violently again.

The doctor cited “situational factors” when Judge Young asked him how it was possible for a mentally healthy person to kill his own child.

At the hearing, the magistrate expressed his concern about the defense's request that Contreras be granted house arrest.

“Another aspect that has me concerned is that the defense has requested, as part of its wish list, that he be placed under house arrest along with his son, daughter-in-law and mother,” the judge indicated. “The bottom line is that he killed his son…is there anything with that…that I should be concerned about for his safety if I put them together?”

When asked by the judge, Dr. Brannon responded: “Whenever there has been violence in a family, the risk of violence within that family increases... In this case, there is no warning sign; There are no prior reports of this behavior. “They support Mr. Contreras.”

Three of Contreras' friends who testified at the hearing indicated that he was a great and loving friend, husband and father, and that they had never seen him as someone violent.

Finally,The judge ordered that Contreras remain in “total confinement” with a GPS monitor and that he can only leave his house to see a doctor or a lawyer..

The defendant must continue attending therapy while he is free, the judge ordered.

During the February hearing, the Cuban father cried and collapsed upon hearing thecall 911 which he did after shooting his son in the head.

In the call he is heard saying: “What have I done? Wasfighting with my son... I lost control, he didn't stop.”

Before the crime, the family had traveled to Orlando to visit Disney, but Eric began to behave differently and so he and his father returned to their home in Kendall.

On the day of the incident, a fight between the two got out of control and ended in a fatal outcome.

According to the arrest report,Contreras shot his son several times “for unknown reasons” and then called the police to report it. Eric was pronounced dead at the scene.

The young man suffered from mental health problems and was undergoing treatment, according to local media in November.
