Florida judge Ailenn Cannon dismissed this Monday the criminal case against former president and Republican presidential candidate Donald Trump for taking confidential documents from the White House.
The ruling, which comes two days after the assassination attempt against Trump in Pennsylvania, represents a legal victory for the former president, as it indicates that one of the four criminal cases opened against him has been completely dismissed.
Cannon argued that the way in which the prosecutor general of the case, Jack Smith, was appointed was incorrect, and that his appointment "violates the Appointments Clause of the United States Constitution."
The judge has issued the ruling after a hearing in which Trump's legal team requested the dismissal of the charges filed by Smith, particularly after the Supreme Court granted him partial immunity, stating that the presidents of the United States cannot be prosecuted once they leave office for acts committed while performing their official duties.
In the case of Florida, Trump faced 31 charges of "intentional withholding of national defense information," each punishable by up to 10 years in prison.
He was also charged with conspiracy to obstruct justice and make false statements.
The documents were recovered in an FBI raid in August 2022 after Trump repeatedly refused authorities' request to return them.
The former president has already reacted to the announcement of the dismissal of the case.
As I move towards unity of our nation following the horrific events of Saturday, this dismissal of the illegal prosecution in Florida should be just the first step, quickly followed by the dismissal of ALL witch hunts: the deception of January 6th in Washington, D.C., the zombie case of the Manhattan district attorney, the New York district attorney’s scam, false claims about a woman I never knew (a decades-old photo of her standing in a line with her then-husband doesn't count), and the "perfect" phone call charges from Georgia”, he said regarding the various accusations against him.
The Democratic Department of Justice coordinated ALL these political attacks, which are a conspiracy of electoral interference against Joe Biden's political opponent, ME. Let's unite to END all the use of our justice system as a weapon and make America great again!," Trump concluded in statements quoted by Telemundo 51.
The good news for the former president has come on the first day of the National Convention of the Republican Party, which will make him the official candidate for the upcoming presidential elections in the United States.
Another not insignificant detail is that the announcement of the dismissal of a criminal case against him comes just two days after the former president survived an assassination attempt at a rally in the town of Butler, in the state of Pennsylvania.
