The Oversight Project, an initiative of the conservative Heritage Foundation that investigates transparency in the U.S. government, reported last Thursday that the majority of the official documents signed by President Joe Biden were authenticated with an automatic signature generated by autopen, rather than a handwritten signature.
Through its account on X, the group stated: "Whoever controlled the autopen, controlled the presidency," implying that Biden did not personally sign key documents of his administration.
"We gathered all the documents we could find with Biden's signature throughout his presidency. All used the same autopen signature, except for the announcement that the former president was withdrawing from the race," the organization stated in its post, accompanied by comparative images of the signatures.
The Oversight Project also reminded on its X account that Biden himself admitted to the Speaker of the House, Mike Johnson, that he did not remember signing an executive order to suspend liquefied natural gas (LNG) exports.
"Then, who signed it?" questioned the organization, insinuating that the leader may not have had control over the signing of official documents, which may have been authenticated using autopen, a device used to replicate signatures automatically on official documents, a practice allowed in the U.S. but that has generated controversy when it comes to high-level decisions.
According to the oversight group, before determining whether the then-president actually ordered the signing of relevant legal documents or if he had the mental capacity to do so, it is essential to clarify who controlled the autopen and what oversight mechanisms were in place regarding it.
The Oversight Project also noted on its X account that this matter could be clarified legally, since Biden himself revoked the executive privilege for individuals who advised former president Donald Trump during his first term.
"Since President Biden decided to revoke executive privilege for those who advised Trump during his first presidency, this is a verifiable fact that can be determined through the proper legal process," they stated in their post.
The Attorney General of Missouri, Andrew Bailey, joined the accusations and urged the Department of Justice to investigate whether Biden's alleged cognitive decline allowed unelected officials to push radical policies without his knowledge or approval.
"I demand that the Department of Justice investigate whether President Biden's cognitive decline allowed unelected officials to push radical policies without his conscious approval," he wrote on his X account.
Bailey warned that if these accusations prove to be true, all executive orders, pardons, and other actions signed without the actual knowledge of the president would be unconstitutional and legally invalid.
Fox News Digital randomly examined over 20 executive orders signed during the Biden administration, recorded in the Federal Register between 2021 and 2024, and found that all carried the same autopen-generated signature.
The media contacted Biden's office for comments on the Oversight Project's revelations regarding the use of the autopen, but as of Sunday, no response had been received.
Additionally, Fox News Digital analyzed the signatures on the executive orders of Donald Trump during his first and second terms, which, according to the report, were also consistent with each other. However, Biden's case has raised greater concern due to increasing doubts about his mental acuity, especially starting from 2024.
That year, Biden began in a strong position within the Democratic Party, preparing his reelection campaign in what seemed to be a rematch against Trump. However, in February 2024, public scrutiny regarding his age (81 years) and cognitive abilities increased, following years of questioning from conservatives about his mental state.
The report by special prosecutor Robert Hur, who investigated the alleged mishandling of classified documents by Biden during his time as vice president, did not recommend criminal charges, describing the president as "an older man, well-intentioned and with a poor memory."
This report heightened concerns about Biden's mental capacity, which reached a critical point in June 2024, after his first and only presidential debate against Trump.
In recent years, the lucidity of the President of the United States, Joe Biden, has been the subject of multiple questions due to a series of public errors and lapses that have raised concerns both in public opinion and within his own party.
One of the most recent episodes occurred in July 2024, during a NATO summit, when Biden confused the President of Ukraine, Volodymyr Zelensky, with the Russian leader Vladimir Putin. The mistake caused confusion among the attendees and generated a wave of criticism.
On the same day, the president also referred to Vice President Kamala Harris as "Vice President Trump," raising concerns about his mental state. His team attempted to downplay the incidents, but figures from the Democratic Party, such as actor and activist George Clooney, publicly voiced their concerns and suggested that Biden should reconsider his candidacy for reelection.
Months earlier, in February 2024, a report by Special Counsel Robert K. Hur described Biden's memory as "blurry" and "poor," noting that the 81-year-old president had forgotten key dates from his tenure as vice president and even the death of his son Beau Biden.
The report generated significant controversy, although it concluded that there was not enough evidence to accuse him of mishandling classified documents. However, this finding reinforced the perception that his cognitive abilities may be declining, especially in the context of his re-election campaign.
Memory issues and confusion from Biden are not new. In September 2022, during an event at the White House, he asked about Congresswoman Jackie Walorski, who had passed away a month earlier in a traffic accident.
The situation caused surprise and discomfort, as the president seemed to forget about his passing, despite having sent condolences to the family days earlier. The White House attempted to justify the incident, but it added to a list of slip-ups that have characterized his administration.
In addition to these episodes, Biden has had embarrassing moments, such as when he fell off his bicycle in June 2022 while riding in Delaware. Although he claimed to be unhurt, the incident went viral on social media and fueled criticism about his physical and mental condition.
These events have heightened doubts about Biden's ability to continue in the presidency and have sparked debate within the Democratic Party regarding the possibility of presenting an alternative candidate in the 2024 elections.
Frequently Asked Questions about the Use of the Autopen in the Biden Administration
What is the autopen and how has it been used during Joe Biden's presidency?
The autopen is a device that automatically replicates signatures on official documents. During Joe Biden's presidency, it has been reported that most official documents were signed using this method, raising controversy over the authenticity and presidential control in key decisions.
What implications does the use of the autopen have for the Biden administration?
The use of the autopen has raised questions about the control Joe Biden has over the signing of important documents. It is suggested that the president may not have been aware of or in control of certain government actions, which has been the subject of criticism and calls for greater transparency in the process of authenticating presidential documents.
What has been the response of the government and authorities to the allegations regarding the use of the autopen?
Until now, there has been no official response from the Biden office regarding the Oversight Project's revelations about the use of the autopen. The lack of response has led to an increase in criticism and calls for investigations into the authenticity of the president's signatures on key documents.
What legal actions are anticipated as a result of the use of the autopen in the Biden administration?
The Attorney General of Missouri, Andrew Bailey, has requested the Department of Justice to investigate whether Biden's cognitive decline allowed unelected officials to push radical policies without his awareness. If the accusations prove true, the executive orders and other actions signed without the president's actual knowledge could be declared unconstitutional and legally invalid.
