Just hours before the federal Real ID requirement in the United States goes into effect, Florida Representative Anna Paulina Luna requested a temporary suspension of the measure from the Department of Homeland Security (DHS), citing concerns about privacy and a possible lack of awareness among many citizens.
According to local media in Florida, Wednesday, May 7, is the deadline to obtain a Real ID, which will be necessary for boarding domestic flights and accessing federal facilities.
Although two decades have passed since the approval of the REAL ID Act in 2005, a recommendation from the September 11 Commission to strengthen security standards for driver's licenses and state identification, the Republican congresswoman warned that many people are still unaware of the requirement.
“I believe that airports are probably very aware that there will be people who don’t even know about this, despite having been spreading many messages about it,” said Luna, representative of District 13, which includes Largo, Clearwater, and Palm Harbor.
Florida was one of the first states to begin issuing Real IDs in 2010, but other states started later, leaving thousands of travelers without this updated document.
The Real ID is marked by a symbol, typically a star, located in the upper right corner of the card in most states. Additionally, it features advanced security measures and requires additional documentation, such as proof of residency and immigration status, in order to be issued.
Luna urged the DHS to halt the implementation until outstanding issues such as privacy and accessibility concerns are addressed. She clarified that she expects the Transportation Security Administration (TSA) to adopt some flexibility in the initial days of enforcement.
“We will see what guidelines the TSA will provide, and I anticipate, I hope, that they will allow people to pass, perhaps giving them a warning and simply telling them that this time they will let them through, but next time it will be considered invalid,” he added.
Although there were no clear signs of an extension until Monday, this Tuesday, the DHS Secretary, Kristi Noem, indicated during a hearing in Congress that travelers without Real ID will be able to fly.
“What will happen tomorrow is that people will go through the line and be asked for their identification (...). If they do not meet the requirements, they could be redirected to another line. An additional step is required, but boarding will be allowed”, explained Noem, according to the agency EFE.
The official did not clarify whether this exception will be limited solely to the initial day or will remain in effect during a transition period. She added that the government aims to implement the law in a “smooth” manner so as not to disrupt travelers' plans, although she insisted that the regulation will be enforced.
Currently, 81% of air travelers already have a valid form of identification, including passports or military IDs, which are also accepted.
Frequently Asked Questions about the Real ID and Its Implementation in the United States
What is the Real ID and why is it mandatory for flying in the United States?
The Real ID is a state-issued identification that meets federal security standards. Beginning May 7, 2025, it will be required to board domestic flights and access federal facilities in the United States. This measure aims to enhance security and make it more difficult to forge documents, as part of the implementation of the REAL ID Act of 2005.
What happens if a traveler does not have a Real ID starting May 7, 2025?
Travelers without a Real ID will be able to fly if they present another type of accepted identification, such as a valid passport. However, they may face delays or be directed to another line for additional screening at the airport. The Transportation Security Administration (TSA) will enforce the rule, but some flexibility is expected at the outset.
What are the requirements to obtain a Real ID in Florida?
To obtain a Real ID in Florida, you must go in person to the DMV with documents that prove your identity, residency, Social Security number, and legal status. Additionally, you must pass specific tests such as the vision and driving exams. The identification features a gold or black star in the upper right corner.
How does the implementation of Real ID affect immigrants in the United States?
The implementation of Real ID significantly affects undocumented immigrants, as they will not be able to board domestic flights without compliant identification. Furthermore, the new regulation complicates access to driver's licenses, especially in states like Florida, where licenses for legal immigrants must be renewed annually.
