"Today, a family is being separated. ICE, during their routine appointment, took my husband, the father of my daughter, into custody," the woman wrote on Facebook.

A young Cuban woman identified as Ana Samira Amador reported on social media that her husband, Samir —father of their daughter and the primary breadwinner of their household— was detained by Immigration and Customs Enforcement (ICE) during a routine appointment in Texas.

The arrest occurred despite the fact that, according to the complainant, the man has no criminal record, infractions, or behaviors that pose a threat to society.

“Today, they are separating a family. ICE, during their routine appointment, took my husband, the father of my daughter, into custody,” the woman wrote on Facebook.

"We don’t know how much something hurts until we face it… They have shattered a harmonious and loving home," she added.

He said that although he does not want to speak ill of the country, he does have serious concerns about the current "administration, where so many injustices are being committed," he stated.

"How much more do Cubans have to prove to obtain political asylum, when the whole world has known how life is in Cuba for over 60 years?" he questioned.

Amador expressed his despair over what he considers a dehumanizing immigration policy that disregards the reality of those fleeing authoritarian regimes.

"It is a country worn down by so much abuse and lies, a people bleeding out without help," he said about life on the island.

This case occurs amidst contrasting testimonies about the immigration process known as I-220A, a measure that allows migrants to await their asylum process under supervision without being detained.

However, some migrants have been unexpectedly detained during routine procedures, with no time for adequate defense or in-depth review of their case.

Human rights advocacy organizations have repeatedly stated that the tightening of immigration policies is unfairly affecting individuals without criminal records who are active members of their communities.

They have also warned about the emotional trauma caused by family separation and the psychological harm to children and couples.

Frequently Asked Questions about the Arrests of Cuban Migrants by ICE in the United States

Why are Cuban migrants being detained when they attend their appointments with ICE?

Cuban migrants are being detained during their immigration appointments due to a tightening of ICE's immigration policies, which includes the enforcement of expedited deportation. This practice allows for the detention of individuals who, even without criminal records, find themselves in complex immigration situations, such as those with Form I-220A. This strategy has been criticized by human rights advocates and attorneys, who view it as a violation of due process.

What is the I-220A form and how does it affect Cuban migrants?

The I-220A form, known as the "Order of Release on Recognizance," allows for the release of individuals under certain conditions, such as attending immigration hearings and not violating laws. This status is not considered an official admission and does not grant immigration benefits, leaving beneficiaries in a state of legal uncertainty. This impacts many Cubans who were hoping to adjust their status under the Cuban Adjustment Act, as they are not regarded as "inspected and admitted" into the country.

What are the criticisms regarding the arrests made by ICE?

Detentions by ICE have been criticized by lawyers and activists for being considered a violation of human rights and due process. It is argued that the detentions are carried out in a calculated manner and not randomly, creating fear and uncertainty among migrants. Additionally, the use of case dismissals as a tactic to facilitate swift arrests and deportations is also criticized.
