The Cuban presenter Alexander Otaola responded vigorously to the statements of Flor de Cuba, who publicly claimed to have won the first hearing in the legal process they are both facing.
In his live broadcast this Friday, Otaola claimed that he does not understand where the supposed victory of his counterpart is.
"We have seen Flor de Cuba come forward to say that she won. I don't know what she won because what was presented today in court was the first motion. My legal team presented four arguments and the judge determined that Flor's defense had not filed the claim as required. The fourth accusation was completely altered, citing laws that do not exist, inventing things that are not within the law, and the judge ordered her to rewrite the claim,” he detailed.
The influencer also explained that the judge granted a period of 10 days to correct the errors in the document, while Flor's lawyer requested 20 days.
"You know what Flor's lawyer did, who is the same as Clarita's from the previous case… He brought some video links and translated below the offense that he claims I said. The judge demanded that he provide a certified translation", she added.
The role of Otaola's lawyers
During the broadcast, Otaola connected live with his lawyers from VPP Law Firm, who reinforced his position by stating that "Otaola does not have to prove anything, and it is Flor who needs to address the lawsuit", calling the hearing a success for their client.
One of the attorneys specified that the judge ordered the removal of one of the charges brought by Flor: “cyberbullying and cyberstalking, which do not exist nor are charges within the State of Florida”.
The second attorney emphasized that, far from being a victory for the plaintiff, the hearing represented a win for Otaola: “They didn’t win today’s motion, you did”.
The version of Flor de Cuba
For its part, Flor de Cuba confirmed hours earlier that it had won the first hearing against Otaola, statements that were included in a previous note from CiberCuba.
“Today justice spoke: I WON the hearing against Otaola. The judge determined that his attacks were made with actual malice, acknowledged the emotional harm, and denied his request to dismiss the case”, asserted the influencer.
Moreover, he stated that Otaola's defense "tried to argue that this was not applicable because they were protected by freedom of expression, but the judge was clear and determined that it is not freedom of expression, that these were words spoken with the intention to cause harm."
The positions of both parties differ greatly and based on their accounts of what happened, it seems that there were two completely different hearings.
