Elon Musk recently became the first person in the world with an estimated net worth exceeding 700 billion dollars, after the Supreme Court of the state of Delaware (USA) made a ruling that reinstates one of the largest compensation packages in corporate history.

What happened and why does it matter?

The story begins with a compensation plan for Musk approved by Tesla in 2018, designed as an incentive for the CEO to achieve extremely ambitious goals related to the company's market value.

That plan was canceled in 2024 by a lower court in Delaware, which deemed it excessive and questioned the way it was approved. However, the decision was overturned by the Delaware Supreme Court, which concluded that completely eliminating that package was inappropriate and unfair, as Musk had not received compensation for six years of work, since his remuneration is tied to stock, not a traditional salary.

As a result, that 2018 package—which originally was worth about 56 billion dollars—now has a value of around 139 billion due to the high price of Tesla's stock.

This recovery helped raise Musk's total net worth above the historic mark of $700 billion, a milestone that few have ever reached in the rankings of billionaires.

Why does this legal ruling involve so much money?

The ruling once again highlighted a package of shares that Musk had not cashed in, significantly increasing his estimated wealth.

The decision reinforces Musk's control over Tesla, which may also impact investors' perceptions.

The ruling comes in a context where Tesla has already approved another payout for Musk (up to $1 billion if he meets very high targets in the coming years), which keeps attention on his financial future.

What did the court say?

In the ruling, the judges indicated that completely voiding the 2018 compensation package was an "excessively extreme remedy" and that leaving Musk unpaid for years of work was not fair. Therefore, instead of canceling the package again, they restored it and awarded a symbolic one dollar in minimal damages, stating that this was the right way to balance things.

Impact beyond Musk

This ruling has sparked a broader discussion about corporate jurisdiction in the United States. Delaware, traditionally the preferred state for registering companies, has faced criticism and has seen movements from some companies seeking more favorable locations to avoid similar litigation in the future.
