The Provincial Court of the Balearic Islands held a preliminary hearing on Wednesday for the trial against three Cuban citizens accused of sexually assaulting a 19-year-old Dutch tourist in a hotel room in Playa de Palma, a case that occurred during the summer of 2021.
The hearing concluded without an agreement between the parties, so the process will continue with an oral trial, although a date for its occurrence has not yet been set, according to OK Diario.
The Prosecutor's Office requests nine years of imprisonment for each of the accused, as well as a joint payment of 75,000 euros as compensation to the victim for the moral damages and psychological repercussions resulting from the attack.
According to the accusation document, the events took place in the early morning of August 9, 2021. The three defendants, who were on vacation in Mallorca, met three Dutch young women of the same age while spending the night in various bars and entertainment venues in Playa de Palma.
After consuming alcoholic beverages, the group decided to continue the gathering in the hotel room where the defendants were staying.
The Prosecutor's Office stated that one of the young women engaged in consensual sexual relations with one of the men. However, around 4:30 in the morning, the victim's two friends returned to their accommodation and, without realizing it, took her mobile phone, leaving her alone and out of communication with the three accused.
According to the accusation, upon realizing that her friends were no longer there, the young woman took refuge in the bathroom out of fear.
It was there that, allegedly, one of the accused entered, kissed her against her will, and began the sexual assault. Subsequently, according to the prosecution's account, the other two men joined the attack.
Physical and psychological consequences
The young woman was urgently transferred to Son Llàtzer University Hospital, a public hospital in Palma de Mallorca, where doctors documented multiple bruises on her arms, legs, and hips.
Additionally, he received immediate medical attention with the collection of biological samples to rule out sexually transmitted infections and the administration of preventive treatment against HIV.
The accusation states that since then, the victim has suffered from post-traumatic stress disorder, requiring ongoing psychological and psychiatric treatment. Among the consequences are recurrent nightmares, anxiety, and severe concentration problems.
The facts are classified by the Prosecutor's Office as a continued offense of sexual abuse, a legal figure in effect at the time of the alleged assault, prior to the enactment of the Spanish Criminal Code reform of 2022, known as the "only yes means yes" law.
The trial is still pending
As no agreement was reached during the preliminary hearing held this Wednesday, the judicial proceedings will continue with the oral trial, the date of which has not yet been determined by the Provincial Court of the Balearic Islands.
The case adds to other recent incidents in Spain where Cuban citizens have been investigated or prosecuted for alleged sexual assault offenses. Among them is the arrest, in April 2025, of six Cubans in Telde (Gran Canaria) for an alleged group sexual assault of a 19-year-old woman, as well as another case reported that same month on the same island.
More recently, in April 2026, the Prosecutor's Office requested imprisonment for a Cuban citizen accused of sexually assaulting a 16-year-old minor also in Gran Canaria.
