The political prisoner's lawyerLuis Robles Elizástigui presented, earlier this month, acassation appeal before the Supreme Court of Cuba against the sentence offive years in prison that was imposed on his client.

“As required by law, the lawyer filed the appeal for 'breach of form' and because the sentence does not comply in the slightest with the law,”confirmed toCuban Diary Edilio Hernández, independent jurist close to the case.

Robles was convicted of the allegedcrimes of contempt and enemy propaganda, after he went out to protest on December 4, 2020 on San Rafael Boulevard, Havana, with a sign calling for the end of repression and the freedom of the rapperDenis Solis, a member of the San Isidro Movement who was then in prison.

“It is very unlikely that any Supreme Court judge will give any reason to Robles, but the family members will exhaust all legal avenues at their disposal. The response from the Supreme Court may take several months to arrive,” Hernández concluded.

The Robles trial, who is being held in the Combinado del Este prison, was held in mid-December 2021, when he had already served a year in prison, and the sentence came after a three-month wait.

Once the trial was concluded, Robles' brother, Landys Fernández Elizástigui, commented toCyberCuba that “the lawyer demonstrated that Luis had not committed any crime, but the Prosecutor's Office continued to insist that (...) he was inciting people to rebel against the revolution.”

Ina letter sent from prison To his brother, Robles explained the reasons that led him to “break the silence.”

The political prisoner said that he felt mobilized after witnessing “many injustices: evictions, persecution, repression, in short, violations of human rights that are supposedly protected in our country” and shared his desire to “live in a country with democracy.” , where the people truly have the power to choose their own destiny and not an imposed one.”

Robles' case took on particular significance because the video of his unusual peaceful protest and its laterarrest, to which he did not resist and what was itrepudiated by many of those who witnessed it at the scene, went viral on the networks.

International and civil society organizations such as the Cuban Observatory of Human Rights, Cubalex, Human Rights Watch and Amnesty International, among others,They have denounced the unfairness of their sentence and demanded his release.

Prisoners Defenders classified Robles as a prisoner of conscience and has denounced the mistreatment and torture of which he has been a victim in prison.
