A federal judge blocked on Monday the decision of the Trump Administration to shut down the U.S. Institute of Peace.

The Institute was illegally taken over by the Department of Government Efficiency (DOGE) of Elon Musk through “blunt force, supported by law enforcement agents from three different local and federal agencies,” ruled U.S. District Judge Beryl Howell, according to a report by AP.

The lawsuit against the dismantling had been filed by former members of the board of directors and the former president of the organization.

The plaintiffs argued that the think tank of experts, established to contribute to conflict resolution around the world, was by law an independent nonprofit organization and, therefore, the dismissal of the board members did not meet any of the requirements mandated by law.

"The Constitution makes it clear that the constitutional authority of the President only extends to Article II, but even Article II does not grant him absolute authority to remove his subordinates, according to current binding jurisprudence," the ruling states.

That is to say, the ruling concludes that the Institute does not exercise any authority of the Executive Power, but rather operates for research, teaching, and academic training in the delicate field of global peace.

In addition, the judge believes that Trump "challenged" the judgment of Congress and President Ronald Reagan when the organization was established, as well as that of all subsequent Congresses.

An executive order from Trump in February had mandated the closure of the Institute. After a failed attempt around that time, federal agents and members of DOGE took over the organization's headquarters.
