A 28-year-old Cuban citizen was arrested this Monday in southwest Miami-Dade, accused of photographing and recording a Walmart employee inside a bathroom stall, according to the Miami-Dade Sheriff’s Office.
The arrested individual, identified as Oscar Chamizo Martin, was caught around 12:15 p.m. in the store located at 14325 SW 268th St., in the Homestead area, when he allegedly extended an iPhone with an orange case over the partition where the victim was located.
The victim, an employee of the establishment, noticed the device and, upon leaving the bathroom, confronted Chamizo Martin, who was the only person present in that area at that time.
Walmart's surveillance cameras captured the employee leaving the bathroom, visibly agitated while calling his manager.
Chamizo Martin left the store after the incident, but a sheriff's deputy contacted his employer and managed to get him to return to the scene.
Back at Walmart, the suspect denied taking any images and claimed it was another person, even though he was in possession of an iPhone with an orange case that matched the exact description provided by the victim.
After being confronted with that evidence, he was arrested and taken to the Turner Guilford Knight Correctional Center (TGK), one of the main jail facilities in the county.
This Tuesday, Chamizo Martin remained in custody with a bail of $2,500 for the charge of digital voyeurism and, additionally, under immigration detention that could lead to a deportation process.
In Florida, digital voyeurism is defined in statute 810.145, which prohibits the use of imaging devices to secretly record individuals in spaces where they have a reasonable expectation of privacy, such as restrooms or changing rooms.
For individuals over 19 years old, the offense constitutes a third-degree felony, punishable by up to five years in prison.
It is not the first time that Cubans in Miami face serious criminal charges related to this type of behavior, against a backdrop where county authorities have ramped up cooperation with federal immigration agencies.
Florida has reported a series of arrests for voyeurism at Walmart stores throughout 2025 and 2026 in various counties across the state, including a case reported just two days earlier in Ocala, where another man was detained for allegedly secretly recording minors in a similar establishment.
The immigration detention regarding Chamizo Martin indicates that immigration authorities have already been notified of his arrest, which raises the possibility that he may face additional consequences beyond the ongoing criminal process.
