Man with HIV sentenced to 18 years in prison for sexual abuse of a minor with a mental disability in Sancti Spíritus.

The 55-year-old aggressor did not care about having HIV and engaged in several unprotected sexual acts with the child at a friend's house of the minor's mother.

The Provincial Court of Sancti Spíritus sentenced a man with HIV to 18 years in prison for sexually abusing a minor who has an evident mental disability.

The 55-year-old aggressor did not care about being a carrier of acquired immunodeficiency syndrome (AIDS) and engaged in sexual acts with the child several times without ever using protection.

According to the newspaper Escambray, the events occurred last year at the house of a friend of the teenager's mother, who has a defective level of psychological functioning and whose mental age is below their chronological age.

The young man would stay overnight some weekends at the house, where the attacker also resided, a single brother of the woman. He seduced him with lascivious treatments, secretly from the rest of the family, and managed to maintain several sexual relationships.

The victim, who attends a special education center, began to show withdrawal, and her teachers managed to get her to tell them what was happening. The teachers, along with the mother, filed a complaint with the Police.

The accused, who had no criminal record, was tried for the crime of corruption of minors, as provided and sanctioned in Article 402, sections 1 and 2, subsection (e), of the Penal Code.

The man appealed the sanction, but the People's Supreme Court dismissed the appeal and upheld the ruling handed down in the first instance.

Escambray emphasizes that this is not the only case of this nature being judged in the Sancti Spíritus court so far this year.

"Such events have in common the excess of confidence and the naivety of family members, who do not notice the dangers of some relationships between minors and adults, and even with other older children," the text states.
