The Inter-American Commission on Human Rights (IACHR), an agency of the Organization of American States (OAS), approved precautionary measures in favor of the Cuban political prisoner Yosvany Rosell García Caso, according to an official notification addressed to attorney Teresa Ortiz, representative of the organization Cuba Demanda Inc.
The resolution, identified as MC-1242-25, was communicated on January 26 by Patricia Colchero, chief of staff of the Executive Secretariat of the CIDH. In the letter, the agency informed that the measure is adopted in accordance with Article 25 of its regulations, and that the corresponding public statement will be published on the official CIDH website.
The wife of the prisoner, Mailin Sánchez, celebrated the decision in a Facebook post, where she expressed her gratitude to attorney Teresa Ortiz “for her excellent work, perseverance, and concern,” as well as to the team supporting the case.
"My husband, family, and I are very grateful to you. Thank you, Father God, for strengthening us," she wrote.
García Caso, a resident of Holguín and father of three children, was sentenced to 15 years in prison for his involvement in the protests of July 11, 2021 (11J). Last December, his health condition raised significant concern following a 40-day hunger strike that resulted in him being admitted to intensive care with renal failure and extreme weakness.
On December 11, he was moved to a penal ward at the Lucía Íñiguez Landín Hospital, where his wife was able to see him briefly. However, just a day later, he was returned to the Holguín Remand Prison, a measure that activists denounced as a possible punishment intended to isolate him and worsen his situation.
International organizations, including Amnesty International and the Cuban Observatory of Human Rights (OCDH), have denounced the inhumane conditions of confinement for political prisoners in Cuba and demanded their release. With this decision by the IACHR, the case of Yosvany Rosell García Caso formally enters the inter-American system for the protection of human rights.
The precautionary measures are a tool of the IACHR to protect individuals at serious risk of suffering irreparable harm to their rights. In this case, the resolution mandates the Cuban state to take immediate actions to safeguard the life and integrity of Yosvany Rosell García Caso, ensure he receives adequate medical care, and prevent reprisals while his situation is being assessed.
